Partner (Provisional and Migrant Visa) Subclass 309 & 100

The Partner (Provisional and Migrant) visa (subclass 309 and 100) allows the spouse or de facto partner of an Australian citizen, permanent resident, or eligible New Zealand citizen to live in Australia. It starts with the temporary 309 visa, and after two years, applicants can apply for the permanent 100 visa.

Partner Visa Subclass 309 & 100 – Eligibility and Key Details

To be eligible for the Subclass 309 Partner (Provisional) visa, you must meet the following conditions:

🔹Apply from outside Australia: You must be outside the country when you lodge your application and when a decision is made.

🔹Relationship requirement: You must be the spouse or de facto partner of an Australian citizen, permanent resident, or eligible New Zealand citizen.

🔹Age criteria: Both you and your partner must be at least 18 years old at the time of application.

🔹Special case for underage sponsors: If your partner is under 18, their parent or legal guardian (who is an Australian citizen, permanent resident, or eligible NZ citizen) must act as your sponsor.

🔹Health and character: You must meet the health and character requirements.

🔹Debt-free: Any outstanding debts to the Australian government must be fully repaid before the visa can be granted.

Eligibility for Partner (Migrant) Visa – Subclass 100

To transition to the permanent Subclass 100 visa, you must:

🔹Hold a valid Subclass 309 temporary partner visa.

🔹Remain in a genuine and ongoing spousal or de facto relationship with your partner, unless special circumstances apply.

🔹Comply with Australian laws and all the conditions of your Subclass 309 visa.

Health and Character Checks

All applicants and their included family members must:

🔹Complete health examinations within 12 months of lodging the application.

🔹Provide police clearance certificates from any country where they lived for 12 months or more over the last 10 years.

Sponsor Responsibilities

The sponsor must agree to provide support for two years after the applicant enters Australia. This includes:

🔹Accommodation

🔹Financial assistance, including the cost of English language classes if required

🔹Other support, such as childcare if necessary

Including Family Members

You can include your dependent children or stepchildren in your visa application.
